any way in the present case, but it appears pro-

bable, although it is not absolutely so stated,

that the person who was assaulted summoned the per-

son who assaulted him, and if such were the circum-

stances, the Magistrate, Mr. Wodehouse, like the

Magistrate at Port Louis, had no option but to hear

and determine the case, according to the municipal

law of the Colony.
